Raffle.it / User agreement
Your use of the Site is governed by the following terms and conditions of use ("Terms"). These Terms form an agreement between you and Raffle It Limited ("us", "we", "our") and we may terminate any account, registration or any other relationship you may have with us without notice in the event of a breach of these Terms. If you do not agree to these Terms, please do not engage further with the website.
Registration and use of this website, www.raffle.it, ("Site") is only open to those over 18 years old who are resident in the UK, Channel Islands and Isle of Man. Business employees or individuals directly involved in the Site, their immediate families and anyone else professionally connected with the Site may not use the Site.
The Site operates online raffles for participants and hosts. Participants win a raffle if they have registered the lowest unique ticket number in a raffle.
Please be aware that the use of the word ‘raffle’ does not imply that we run raffles within the meaning of the Gambling Act 2005 or any legislation of a similar nature. As a result, we are not regulated or otherwise under the auspices of the Gambling Commission. We do, however, regularly monitor our operation to ensure that it complies with the law. Any use of the word ‘raffle’ refers to our lowest unique bid auction process.
If you are registering on the Site as a business entity, you represent that you have the authority to legally bind that entity. If you are trading as a business on the Site, you must comply with all applicable laws relating to online trading.
Unless both you and Raffle It Limited agree otherwise in writing, you will not be able to cancel this agreement under the Consumer Protection (Distance Selling) Regulations 2000 (or any equivalent legislation in your jurisdiction) once the supply of our services has commenced. For the avoidance of doubt, the supply of our services has commenced when you have entered one of our raffles as a buyer through our Site.
We may alter the Terms from time to time and we will post the updated Terms to this Site. Each time you access the Site, you are agreeing to the Terms which are displayed on this page from time to time and so we strongly recommend that you check this page each time you visit.
These Terms are governed by English law. If you are accessing this site from the UK, Channel Islands or Isle of Man any disputes arising out of your use of the Site will be determined in your local courts only. In the event that you are accessing this site from any destination other than the UK, Channel Islands and Isle of Man, please be aware that you are in breach of these Terms and any dispute arising out of your existing and or continued use will be determined by the English courts, to whose non-exclusive jurisdiction you agree to submit.
If you do not agree to these Terms then do not proceed to use the Site.
By accessing and using the Site then you agree to the following:
1. Registration
- Joining Raffle.it is completely free, although you will need a credit or debit card to purchase tickets.
- Registering is very straight forward. We ask for your name, a preferred Raffle.it user name, your email address, a password and confirmation that you are over 18 years old. You will need to complete your credit or debit card billing address details (which will also be used as your delivery address) when paying for your tickets.
- You warrant that the information you provide to us, whether as part of the registration process or otherwise, is complete, true, accurate and not misleading in any way and you agree that you will, on request, provide further information to us, at your cost, should we need to further verify your identity prior to sending anything to you.
2. Your account
- You must inform us immediately by emailing us at cutomer.services@raffle.it or by writing to us at Raffle It Limited, Tulya House, 69 High Street, Bagshot, Surrey, GU19 5AH, UK, if:
- there has been unauthorised use of your account; or
- any of your account details or other personal information has changed since your last login.
- If it transpires that, in our reasonable and sole opinion, a winning ticket has been procured fraudulently via your account or by another person using your account, with or without your permission, then the raffle prize will be allocated to the holder of the next lowest unique number.
3. Using the site
- You agree that you will not at any time do or cause to be done any of the following:
- post or upload offensive content;
- knowingly or otherwise do anything that would constitute a breach of any laws;
- knowingly or otherwise infringe the copyright, trade mark or other rights of third parties.
- interfere with any raffles;
- circumvent or manipulate our fee structure, the billing process, or fees owed to us;
- post, list or upload false, inaccurate, misleading or defamatory content (including personal information);
- distribute or post spam, chain letters, or pyramid schemes;
- distribute viruses or any other technologies that may harm us, or the interests or property of our users;
- harvest or otherwise collect information about users, including email addresses, without their express consent;
- take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure.
- no item posted on the site shall offend generally accepted public decency and we reserve the right to remove such items without notice.
4. Purchasing tickets
- A limit is placed on the number of tickets you can purchase in any raffle. This is to protect you and ensure fairness for all those participating in the raffles. The limit for any raffle will be fixed on commencement of that raffle and will always be shown on the raffle's description page.
- Ticket purchases are delivered to your Raffle.it Account instantly and their uniqueness status updated throughout the life of the associated raffle. A copy of the transaction will also be emailed to you shortly after completion of your purchase.
- Ticket purchase refunds will be made at our discretion.
- All promotional instructions form part of these Terms. Individual raffles may have different requirements or conditions. In particular, they may have specific age requirements and, where that is the case, winners will be required to provide proof of age where necessary.
5. Reward Vouchers
- Reward Vouchers are defined as discount offers, money off coupons, cash back offers or free item claims.
- Where Reward Vouchers are awarded with a ticket purchase, these vouchers will be stored in your Raffle.it Account.
- By default, your Raffle.it account will automatically accept all Reward Vouchers passed to it. You can change this setting from within your Raffle.it Account.
- Where Reward Vouchers are accepted, your details may be shared with the provider of the Reward Voucher
6. Winning
- The owner of the winning raffle ticket will be contacted by email within one business day of the raffle closing and will be given the details for claiming their prize. Where possible, prizes will be delivered, either by courier or Royal Mail, within 3 - 5 business days of a winner being declared, unless different conditions are stated in the terms of a particular raffle. Where we deem appropriate, prizes may be dispatched to you directly by our supplier. If we do not have the winner’s address details on file, the winner will have one week to update their account record. Failure to do so may result in them losing claim to their prize.
- In the event that the advertised prize is no longer available or is deemed not fit for purpose as described on the site, the winner will receive the prize fund for that raffle instead of the advertised prize.
- Details of all completed raffles, together with the ticket numbers that were chosen, will be made available on the Site.
- You agree that, if you are the winner of a raffle, we may feature your name, your user name, photo or avatar and postal district/county in future promotions, marketing and advertising.
- In the event that no unique number is found, the winner will be the person that first selected the lowest number chosen by the least number of participants.
- If we deem the winning raffle ticket has been procured by a syndicate or group bidding process which is unfair to the spirit of the raffle, then the raffle prize will either be allocated to the holder of the next lowest unique number or an investigation will be undertaken, during which time the raffle will be suspended.
- Each raffle will have a termination date/time. Each raffle shall remain open until all tickets are sold or the termination date/time is reached, whichever is the sooner, excepting that any raffle may be revoked at any time by notice from us. Where a raffle terminates before all tickets have been sold, the winner will receive the prize fund for that raffle instead of the advertised prize, unless the terms of the individual raffle state that the prize will be awarded irrespective of the number of tickets sold.
7. Privacy
- We do not sell or rent your personal information to third parties for their marketing purposes. We use your information only as described in our Privacy Policy.
- Where you have been allowed access by a user to their data, you must give the user a chance to remove themselves from your database and a chance to review the information you have collected about them in accordance with prevailing data protection legislation. - We may hold and use the information you provide for future marketing purposes and notification of promotional offers. If you do not wish your details to be held or used for these purposes then please e-mail us at customer.services@raffle.it and request that this information is removed from our databases.
- You agree to indemnify and hold harmless Raffle It Limited for any breach by you of any data protection, privacy or similar legislation. For the avoidance of doubt, in addition to any damages or other awards made, you agree to be responsible for the reasonable legal and professional fees of Raffle It Limited in respect of such a claim.
